A partire dal 1997 l’ordinamento inglese è stato interessato da una serie di leggi di rilevanza costituzionale, tra cui il Constitutional Reform Act, approvato nel 2005 con l’intento di realizzare una piena separazione dei poteri in chiave di garanzia dell’indipendenza dei giudici. Dopo aver delineato un quadro complessivo dell’amministrazione della giustizia in Inghilterra, il lavoro ricostruisce le ragioni e l’inconsueto iter di approvazione della legge per concentrarsi poi sui tre profili toccati dalla riforma e sul modo in cui questa sta vivendo nella pratica. Innanzi tutto, la figura del Lord Chancellor che, pur non essendo stata abolita, ha perso molte delle sue peculiarità e dei suoi poteri. In secondo luogo, la nomina dei giudici, adesso incentrata su una commissione a hoc, la Judicial Appointments Commission. Infine, la UK Supreme Court, che ha sostituto l’Appellate Committee della House of Lords come corte di vertice del Regno Unito. ENGLISH VERSION Since 1997, the English legal system has witnessed a series of reforms of constitutional significance, including the Constitutional Reform Act 2005, which aimed at modernizing the legal system and achieving a clearer separation of powers in order to guarantee the full independence of the judiciary. Three key elements of the system have been touched by this reform: the office of Lord Chancellor, judicial appointments and the court of last resort for the United Kingdom. This book starts with a broad picture of the English legal system before the changes produced by the Act; then illustrates the main reasons for the reform and retraces the unusual way through which it has been achieved, and concludes with an analysis of its implementation. While not disregarding the significance of the changes brought forward by the Constitutional Reform Act, this work tries to highlight also the elements of continuity with the previous situation and the importance of the implementation of the Act in order to gain a full understanding of its impact and its meaning.
