La legge 16 aprile 2015, n. 47 ha inciso profondamente su alcuni snodi centrali del procedimento applicativo delle misure cautelari personali coercitive. SI tratta di un intervento legislativo complessivamente teso a riequilibrare i diritti del ristretto in vinculis con le finalità di giustizia. Ciò nonostante, il legislatore non ha abbandonato il ricorso ai meccanismi presuntivi per i delitti più gravi e di associazione mafiosa, terroristica e sovversiva. Il volume esamina sistematicamente i tratti principali e le più importanti questioni relative alla disciplina delle presunzioni cautelari. Ricostruita l'evoluzione storica della normativa sulla custodia cautelare e ripercorsa la giurisprudenza della CEDU in materia di restrizioni ante iudicium, sono affrontate le criticità connesse all'impianto normativo cautelare che la riforma del 2015 non pare avere del tutto fugato. L'attenzione si è focalizzata sul mantenimento di meccanismi presuntivi automatici nell'applicazione della misura restrittiva che danno vita ad attriti con i principi del sistema cautelare e, specificamente, con il principio di proporzionalità. Per risolvere tali questioni è necessario richiamare gli strumenti di teoria generale che ruotano intorno al tema dell'onere della prova nel processo penale ed a quello delle cd. presunzioni semplici nel processo civile. In questa prospettiva si è proceduto ad un'analisi organica delle nuove norme, valutandone gli aspetti di frizione con i principi costituzionali e convenzionali, al fine di proporre una lettura funzionale che permette di trovare un bilanciamento tra tutela dei diritti dell'accusato ed efficienza della macchina giudiziaria.The Law April 16, 2015, no. 47 deeply impacted on some of the focal points of the application process of personal measures of preventive detention. This reform is aimed at rebalancing the rights of the restricted in vinculis with the needs of justice. Nevertheless, the legislator has not abandoned the recourse to the presumptive mechanisms for the most serious crimes and mafia, terrorist and subversive associations. The scientific book systematically analyzes the main features and the most important issues related to the discipline of precautionary presumptions. After reconstructing the historical evolution of the precautionary custody regulation and retracing the jurisprudence of the ECHR on this matter, the critical issues related to the precautionary regulation are analyzed . Taking into consideration that these critical issues have not been completely dispelled by the reform, the attention is mainly focused on the maintenance of automatic presumptive mechanisms in the application of the restrictive measure which give rise to frictions with the principles of the precautionary system and, specifically, with the principle of proportionality. To solve these issues it is necessary to recall the general theory concepts that revolve around the issue of the burden of proof in the criminal process and simple presumptions in the civil process. In this perspective, an organic analysis of the new rules has been carried out, evaluating the friction aspects with constitutional and conventional principles, in order to propose a functional interpretation that allows a balance between protection of the rights of the accused and efficiency of the judicial machine.
