Surrogate Motherhood: Protecting the Best Interests of the Child in Light of Recent Case Law

Surrogate motherhood is a highly debated issue, and one for which there is now considerable case law. However, adequate protection for the multiple interests at stake has yet to be offered, especially in those legal systems in which lawmakers have been slow in intervening, or dig in behind absolute prohibitions unable to stem the phenomenon of procreative tourism. This essay reconstructs the position of the ECtHR and of Italy’s Constitutional Court and Court of Cassation in their most recent rulings, with the aim of understanding the diverse approaches taken to identify the best interests of the child. The critical observations to the jurisprudential arrests constitute useful reflections in view of the desired intervention of the legislator. La maternità surrogata è un tema molto dibattuto e sul quale, oramai, è intervenuta una cospicua giurisprudenza, sebbene non sia ancora offerta una tutela adeguata ai molteplici interessi in gioco, soprattutto in quegli ordinamenti in cui il legislatore tarda ad intervenire o si trincera dietro divieti assoluti che, però, non riescono ad arginare il fenomeno del turismo procreativo. Il contribuito ricostruisce la posizione della Corte EDU, della Corte costituzionale e della Corte di cassazione nelle pronunce più recenti allo scopo di comprendere la diversità di approccio nella individuazione del miglior interesse del minore: le critiche agli arresti giurisprudenziali costituiscono delle riflessioni utili in vista dell’auspicato intervento del legislatore.
