This paper focuses on a recent decision of the U.S. Supreme Court concerning a central issue in the current international debate: treatment of migrants awaiting a decision to grant a valid residence permit in the U.S. and the choice of the most appropriate method to identify the range of personal freedom guarantees offered to those foreign persons in these circumstances.
