The Constitutional Court reiterated the unconstitutionality of the punitive automatisms in the area of parental responsibility because the principle of the best interests of the child requires that the suspension of parental responsibility is in accordance with the child’s needs when is applied. Furthermore, punitive measures cannot directly and inevitably involve a not guilty person particularly protected by the legal system. This creative judgment, while placing itself in the wake of the constitutional case-law, presents multiple profiles of interest that this essay reconstructs by paying attention to those arguments that may also be useful in other particularly topical areas.
