Il decisionismo governativo: uso e abuso dei poteri normativi del Governo durante la crisi da COVID-19

The COVID-19 outbreak had a great impact on the legal systems of European states. At national level, the institutional reaction to the virus has unleashed confusion and turmoil with overlapping roles, threats for the separation of powers, risks for the rule of law and even the fear of new forms of dictatorship in some countries. Consequently, the COVID-19 crisis represents an interesting scenario to analyze the role of the constitutional governments in the XXI century. In this perspective, the essay aims to analyze the regulatory role of the Italian cabinet during the COVID-19 outbreak; the study will first analyze the Italian constitutional framework, later it will focus on the political and institutional dynamics that marked the enactment of regulations chains composed of the decree-laws and decrees of the President of the Council of Ministers.
