Processo senza soggetti. Contributo allo studio delle «gestioni patrimoniali autonome» nel processo

Sempre più spesso si manifestano rapporti giuridici che, sul piano sostanziale, si riferiscono ad un patrimonio, prima ancora che ad un soggetto; rapporti che, una volta divenuti controversi, devono trovare spazio nel processo. Già Redenti si chiedeva chi potesse agire, e a quale titolo, al cospetto di «gestioni patrimoniali autonome», rispetto alle quali l’esercizio dell’azione «non coincide né con l’agire in nome proprio, né con l’agire in nome altrui»; «casi singolari» che ormai con frequenza si incontrano nella realtà odierna. Per dirla con Orestano, l’esigenza da cui muove lo studio è proprio quella di ricostruire i rapporti tra diritti e azione quando dietro la «personalizzazione del patrimonio» non ci sia «altra realtà che [...] un patrimonio senza soggetto». Nel contributo si cercherà allora di comprendere se e come i consolidati modelli di esercizio dell’azione possano operare quando nel processo agisca un patrimonio «in gestione». On a substantive level are increasingly arising legal relationships that refer to a patrimonial assets rather than to a subject; relationships that, once they become contentious, must find their place in the judicial process. Already Redenti questioned who could act, and on what grounds, in the interest of "autonomous asset management", in relation to which the exercise of the action "neither coincides with acting in one’s own name, nor with acting on behalf of another"; "singular cases" that are now frequently encountered in contemporary reality. To quote Orestano, the aim of the study is precisely to reconstruct the relationship between rights and action when, behind the "personalization of the patrimony," there is "no other reality than... a patrimony without a subject." The monograph will then seek to understand whether and how the established models of exercising legal actions can apply when a patrimony "under management" acts in civil proceedings.
