This essay carries out some critical reflections regarding sentence no. 240/2021 of the Constitutional Court. In this ruling, the Constitutional Court once again dealt with law no. 56/2014 by carrying out a revirement with respect to the previous decisions. This essay focuses on the position taken by the Consti-tutional Court with regard to the identification ope legis of the Metropolitan Mayor and the consequent warning it addressed to the lawmaker.
