Nel cap. XI de De ratione di Vico è richiamato più volte l’editto del pretore considerato come la scaturigine del diffondersi dei libri de iure. Alla pubblicazione dell’editto riordinato da Giuliano viene ricondotta l’origine dell’esperienza letteraria della giurisprudenza romana. Si tratta di un’evidente forzatura, visto che le trattazioni giuridiche erano diffuse anche in età pre-adrianea, che nasconde e rivela nell’interpretazione vichiana un assunto, probabilmente, soltanto intuito: se da un lato, nell’esercizio della giurisdizione si affermava la polarità tra diritto delle leggi e disposizioni del magistrato a partire dall’aequitas, era nell’interpretatio dei giuristi che trovava una sintesi la tensione tra diritto naturale ed equità In ch. XI of Vico's De ratione, the edict of the praetor is referred to several times and considered as the source of the spread of the libri de iure. To the publication of the edict rearranged by Julian is traced the origin of the literary experience of Roman jurisprudence. This is an obvious stretch, given that legal treatises were widespread even in the pre-Adrian era, which conceals and reveals in the Vichian interpretation an assumption, probably, only intuited: while the polarity between the ius of the laws and the magistrate's dispositions from aequitas was affirmed in the exercise of jurisdiction, it was in the jurists' interpretatio that the tension between natural law and equity found a synthesis.
