Hybrid criminal justice: reconstruction and developments of the phenomenon

Hybrid criminal tribunals are jurisdictions that have elements derived from the international system mixed with elements typical of the local legal systems with which they are confronted. The crisis in international relations, growing disillusionment with the International Criminal Court, and the continuing need to affirm international justice, safeguard peace and security, and combat impunity are leading the international community to seek innovative solutions for the prosecution of international crimes. Among these, the proposal to establish mixed criminal tribunals emerges several times, in a necessary dialogue between international and domestic law. The handbook therefore attempts to reconstruct the phenomenon of hybrid justice, systematically re-reading its transformation from a sporadic experience in Cambodia, Sierra Leone, Kosovo and Timor Leste to a consolidated and attractive model of conducting trials for the most serious crimes committed against humanity.
