IL DIRITTO COSTITUZIONALE E LA CYBERSICUREZZA. ANALISI DI UN VOLTO NUOVO DEL POTERE

In recent years, cybersecurity has emerged as a problem beyond technology and has become a strategic priority that national governments, in particular, must address. The article first contributes to clarifying the possible uses of cybersecurity within legal disciplines. It shows how this concept has evolved in recent years due to increased investment in the power of “resilience” against cyber threats. Secondly, the article discusses how cybersecurity today has taken on the characteristics of a new “face” of power and should be analysed as such in constitutional law studies. To this end, the implications for fundamental freedoms and rights and the dynamics of the separation of powers are highlighted. By examining the constitutional implications of cybersecurity, this paper aims to contribute to developing sound legal strategies that support the integrity and security of the digital space while respecting constitutional values and principles.
