Giudizi prognostici e diritto penale. Luoghi, funzioni, garanzie

Nel sistema penale la prognosi è riuscita a farsi strada tanto sul fronte del trattamento punitivo, quanto su quello della teoria del reato. Si tratta di un fenomeno ampio, assai maggiore dell’impressione che se ne possa avere a prima vista, articolato lungo direttrici diverse, a seconda che la valutazione predittiva si conformi “a sviluppo aperto” oppure “a esito noto”. La curvatura prospettica del giudizio, sia quando prende di mira eventi che non si sono ancora verificati, sia quando procede ad una rilettura di fatti del passato, abbraccia forme di ragionamento multiple, guidate da criteri orientativi ampiamente discrezionali, che talvolta neppure rinvengono parametri formalizzati. Il ruolo della prevedibilità, al cui accertamento la prognosi si indirizza, è tutt’altro che ancillare, rivelando uno stretto intreccio tra il piano sostanziale e quello processuale. *** In the penal system, prognosis has managed to make its way both on the front of punitive treatment and on that of the theory of crime. It is a broad phenomenon, much larger than the impression one might have at first sight, articulated along different lines, depending on whether the predictive evaluation conforms to "open development" or "known outcome". The prospective curvature of the judgment, both when it targets events that have not yet occurred and when it proceeds to a rereading of past facts, embraces multiple forms of reasoning, guided by largely discretionary orienting criteria, which sometimes do not even find formalized parameters. The role of predictability, to the ascertainment of which the prognosis is directed, is anything but ancillary, revealing a close intertwining between the substantive and procedural levels.
