Il diritto dell'informazione e della comunicazione nell'era dell'intelligenza artificiale

La disciplina del diritto dell’informazione ha conosciuto una svolta significativa: lo sviluppo di nuove tecnologie ha progressivamente reso fungibile una pluralità di mezzi di comunicazione per l’esercizio di attività riconducibili alla nozione di informazione. Attività che in passato contavano su una regolamentazione distinta (stampa, radiofonia, televisione), a seconda del vettore utilizzato, conoscono ora una convergenza che investe anche la normativa del settore. La nuova edizione del manuale illustra questo processo in relazione al quadro giuridico di riferimento, prestando una rinnovata e particolare attenzione all’ondata regolatoria proveniente dall’Unione europea: una serie di fonti (su tutti il DSA, il DMA e, da ultimo, l’AI ACT) che ripresentano con forza a tutti gli operatori del diritto le specifiche questioni che le libertà fondamentali pongono nel contesto della Rete. The regulation of information law has undergone a significant change: the development of new technologies has progressively made a plurality of media fungible for the exercise of activities falling under the notion of information. Activities that in the past relied on separate regulation (press, radio, television), depending on the vector used, are now experiencing a convergence that also affects the regulation of the sector. The new edition of the handbook illustrates this process in relation to the legal framework of reference, paying renewed and particular attention to the regulatory wave coming from the European Union: a series of sources (above all the DSA, the DMA and, most recently, the AI ACT) that forcefully re-present to all legal practitioners the specific questions that fundamental freedoms pose in the context of the Web.
