Le conseguenze giuridiche per le istituzioni dell’Unione europea dell’accertamento dell’illegittimità dei propri atti

A seguito di una sentenza che evidenzia l'illegittimità di atti dell'Unione, si rende di regola necessario un intervento delle istituzioni per allineare la realtà giuridica all'accertamento giurisdizionale e garantire alla parte vittoriosa una tutela effettiva. L'A. offre una ricostruzione critica dell'ampio ma poco esplorato corpus giurisprudenziale relativo alla disposizione, ora contenuta nell'art. 266 TFUE, secondo cui le istituzioni devono adottare i provvedimenti necessari per conformarsi. Vengono esaminati la natura, la portata e il contenuto di tale obbligo, soffermandosi sui numerosi vincoli che inquadrano la discrezionalità delle istituzioni e, al contempo, sui limiti strutturali che investono l'effettività dell'obbligo stesso. Infine, l'A. si interroga sull'esistenza e il fondamento di un obbligo di conformarsi nelle ipotesi in cui l'accertamento dell'illegittimità esorbita dall'(attuale) perimetro dell'art. 266 TFUE. Following a ruling that highlights the unlawfulness of EU acts, the institutions usually need to take action to align the legal situation with the judicial finding and ensure effective protection for the winning party. The author critically reconstructs the extensive yet under-explored body of case law relating to the provision, now enshrined in Article 266 TFEU, which stipulates that the institutions must take the necessary measures to comply. This obligation is examined in terms of its nature, scope and content, with a focus on the numerous constraints that limit the discretion of the institutions and the structural limits that affect the obligation's effectiveness. Finally, the author questions the existence and basis of an obligation to comply in cases where the finding that an act is unlawful exceeds the current scope of Article 266 TFEU.
