Tecniche internazionalprivatistiche a tutela del superiore interesse del minore: flessibilità alla ricerca del miglior risultato nel caso concreto

The work focuses on private international law methods used in order to guarantee «the best interests of the child» in each decision concerning children (article 3 CRC). The a. tries to show how, and to what extent, «the best interests of the child» principle requires “flexibility”, or even derogations, to the traditional private international law methods, dealing with jurisdiction, applicable law and enforcement of foreign judgments concerning children. The work focuses mainly on the EU Regulation n. 2201/2003 (and its recast) and the 1996 Hague Convention on parental responsibility and the protection of children, with some occasional references to Italian legislation (in particular, legislation on filiation).
