L’idea di costituzione nella giuspubblicistica italiana degli anni Trenta

Il saggio muove da un presupposto ben preciso, ossia che sia effettivamente esistito un ordinamento costituzionale fascista e, conseguentemente, anche una cultura costituzionale fascista. La prima parte del saggio è dunque dedicata a giustificare le ragioni di questa tesi di partenza, mentre nella seconda si ripercorrono le tappe della progressiva costruzione dell’ordinamento costituzionale fascista, concentrata soprattutto nella XXVII legislatura, considerabile alla stregua di una vera e propria legislatura costituente. La terza parte del saggio, invece, si sofferma più specificatamente sull’aspetto dottrinale e, in particolare, sull’elaborazione svolta negli anni Trenta attorno al concetto di regime, considerato come un tema centrale e propedeutico alla preparazione della teoria mortatiana della costituzione in senso materiale del 1940. The essay assume the thesis that a fascist constitution and a fascist constitutional culture actually existed. The first part of the essay is therefore dedicated to justifying this thesis, while the second one aims to explain the main stages of the progressive building of fascist constitutional order, concentrated mainly in the XXVII legislature, which can be considered as a real constituent legislature. The third part of the essay focuses more specifically on the doctrinal aspect and, in particular, on the elaboration, carried out in the thirties, of the concept of regime, considered as a central and preparatory item for the ideation of a theory of constitution, taking as reference work in this regard the essay La Costituzione in senso materiale written by Mortati in 1940.
