La responsabilità civile tra funzione riparatoria e funzione sanzionatoria

Il saggio costituisce lo sviluppo di una relazione tenuta nell'ambito di un seminario dottorale che si inserisce nell'ambito delle iniziative del Dipartimento di eccellenza ed è pubblicato presso un'autorevole casa editrice. Il saggio si propone di analizzare il tema attuale e di grande rilevanza delle funzioni ascrivibili all'istituto della responsabilità civile alla luce di una recente decisione delle Sezioni Unite e di numerose disposizioni in cui si prevedono risarcimenti punitivi o strumenti sanzionatori. La particolare rilevanza di tale studio consiste nel tentativo di analizzare l'evoluzione dell'istituto in esame riflettendo sui rapporti che intercorrono tra il sistema del diritto penale (cui è naturalmente correlata l'istanza sanzionatoria) e il sistema del diritto civile che, ciclicamente, si dota di nuovi strumenti con funzione sanzionatoria (astraintes, sanzioni civili pecuniarie, risarcimenti multipli). Il risultato dell'indagine è quello di tentare di avviare una riflessione volta a mettere ordine tra i concetti distinguendo tra i risarcimenti punitivi e le sanzioni civili. The essay is the result of a lecture hold in a doctoral seminar that is part of the events of the Department of Excellence and it is published by an authoritative editor. The essay aims at analyzing the current and relevant issue of the functions of the civil liability also on the basis of a recent decision of the United Section of the Court of Cassation and of several laws concerning punitive damages or punitive tools. The peculiar relevance of the study consists in the attempt to analyze the evolution of the present institute reflecting upon the relationships between the criminal law system (which has a natural punitive character) and the civil law system, that often introduce tools with punitive functions (astraintes, pecuniary civil sanctions, multiple compensations). The result of the analysis it the attempt to begin a reflection in order to bring order among different concepts, distinguishing between punitive compensations and civil sanctions.
