After a brief description of the the constitutional framework of access to justice in Italy, the report analyses the major items of litigation costs trying to evaluate their size in the light of the actual cost of living, to turn then to the cost allocation regime. Against this backdrop, the second part analyses the available public and private mechanisms to aid litigation in Italy as well as other existing frameworks allowing cost-effective resolution of disputes, in particular class actions and ADR. Finally, the impact of IT and AI on access to justice is explored.
