Minori di età e Islam: problematiche attuali

The paper explores the interplays between minors’ law and Islam under three different viewpoints. In the first paragraph we analyze the trend, in Italian and European case-law, toward an increasing recognition of kafala as a typical Islamic instrument of minors’ protection. In the second paragraph we focus on the first Italian judicial decision dealing with a family conflict on the practice of the Ramadan fast by a minor. In the third paragraph we consider, also in a comparative perspective, the recent developments regarding the fight against child marriages and its contradictions
