La formula come strumento giuridico

In Von der Poesie im Recht, Grimm suggerì per la prima volta l’idea (romantica) di una stessa origine per il diritto e la poesia germanici, assunto che diventa addirittura un topos e che informa ancora il dibattito scientifico. Uno dei fattori alla base di questo binomio è proprio la condivisione, da parte delle leggi e della poesia, di una stessa forma linguistica caratterizzata dagli stessi elementi lessicali e retorici, in primis le formule. Recependo quanto auspicato da Sonderegger (1962), si propone un’analisi delle formule presenti nelle leggi anglosassoni, che ne definisca una tipologia linguistica e un’interpretazione testuale allo scopo di valutarne la funzione retorica, mnemonica e semantica, ovvero come espediente per creare concetti giuridici. Il confronto con altri generi testuali ci permetterà di mettere a fuoco una questione fondamentale della natura delle formule giuridiche e della “poeticità” del diritto, come frutto di quello spirito del popolo del cui atto collettivo poesia e legge sono, per Grimm, l’espressione.
