Navigating technological neutrality: the challenge of tokenized bank deposits and the regulatory framework of MiCAR

L’approvazione del regolamento europeo sui mercati delle cripto-attività (i.e. MICA) ha segnato un primato nel settore a livello internazionale, divenendo nel contempo un punto di partenza per ulteriori e successive valutazioni su tematiche sia incluse, che escluse dal perimetro codificato. L’applicazione “sperimentale” del framework approvato ha inaugurato un cantiere normativo in fieri, che deve costantemente confrontarsi con le sfide competitive e di coordinamento provenienti da più fronti, europei ed internazionali, imponendo così un’estensione del panorama di osservazione oltre l’orizzonte di MICA. Il volume, in un confronto a più voci di accademici, rappresentanti delle Autorità e di Associazioni di categoria, raccoglie contributi, osservazioni e riflessioni sui diversi sviluppi in corso nel mercato globale delle cripto-attività, profilando le imminenti novità normative che segneranno l’inizio del processo di transizione verso MICA 2. The approval of the European regulation on markets in crypto-assets (i.e. MICA) marked a milestone in the sector at international level, while also becoming a starting point for further and subsequent assessments on issues both included and excluded from the scope of codification. The “experimental” application of the approved framework has inaugurated a regulatory work in progress, which must constantly address competitive and coordination challenges from multiple perspectives, both European and international, thus requiring an extension of the field of observation beyond the horizon of MICA. The volume is a discussion between academics, representatives of the authorities and trade associations and brings together contributions, observations and reflections on the various developments underway in the global crypto-asset market, outlining the imminent regulatory changes that will mark the beginning of the transition process towards MICA 2. The volume is part of the Economic Law Series and deals with one of the most salient issues in the field of digital innovation, with a particular focus on decentralised finance, crypto lending and crypto staking, as well as NFTs, stablecoins, sustainability and finance tokenization.
