The article deals with the interpretation of the notion of “dismissal”, developing a critical dialogue with the solutions proposed by the Court of Justice and the Italian Supreme Court. The examination of the main controversial issues regarding the interpretation of the notion of “dismissal” is accompanied by the formulation of some proposals for a reinterpretation of the institute.
