Sovranità, potere e libertà nell’era dell’AI

Gli sviluppi assai significativi dell’intelligenza artificiale registratisi in questi anni interrogano in maniera profonda il diritto costituzionale, alla luce dei molteplici riflessi che l’AI proietta sui principali oggetti della scienza costituzionalistica: da un lato, i congegni di legittimazione e limitazione del potere; dall’altro lato, la garanzia dei diritti e delle libertà fondamentali. Un ambito d’indagine di particolare interesse è quello delle assemblee rappresentative, che stanno già oggi sperimentando in numerosi ambiti di attività le nuove tecnologie, in particolare quelle derivanti dalle applicazioni di AI generativa. In questa prospettiva, il volume offre una prima lettura sistematica di tali linee di innovazione, tematizzandone l’impatto attraverso alcune categorie fondamentali del costituzionalismo (sovranità, potere, libertà, rappresentanza politica, spazio pubblico), per poi analizzare le possibili trasformazioni indotte dall’AI sul piano sia dell’organizzazione che delle funzioni parlamentari, a cominciare da quelle legislative, di bilancio, di indirizzo e controllo. The very significant developments of artificial intelligence in recent years deeply question the constitutional law, in the light of the many reflections that AI projects on the main objects of constitutional science: on the one hand, the devices of legitimacy and limitation of power; on the other hand, the guarantee of fundamental rights and freedoms. A field of investigation of particular interest is that of representative meetings, which are already experimenting in many areas of activity with new technologies, in particular those deriving from generative AI applications. In this perspective, the volume offers a systematic first reading of these lines of innovation, thematic the impact through some fundamental categories of constitutionalism (sovereignty, power, freedom, political representation, public space), and then analyze the possible transformations induced by AI on the level of both organization and parliamentary functions, starting with legislative, budgetary, address and control.
